2. 법리적으로 매매계약의 실제 대상은 돌담 경계에 따른 토지가 아니라 지적공부상의 토지라는 점, 토지 경계 불일치 사실에 대해서 의뢰인도 알지 못한 점을 검찰에 소명하였습니다.
