1. 미성년 자녀(만1세)의 친권 및 양육권에 대하여 첨예한 대립이 있었습니다.
2. 통상적으로 친권 및 양육권에 대해서는 부보다 모가 유리합니다. 배우자의 폭행 등 귀책사유를 이유로 친권 및 양육권을 의뢰인에게 주어야 한다고 주장했으나, 재판부는 그것이 자녀에 대한 것은 아니므로 받아들이지 아니하였습니다.
3. 소송절차로 계속 진행하면 불리해질 것으로 판단, 배우자를 폭행 등으로 형사고소하여 압박하였습니다.
4. 형사고소 취하를 조건으로 친권 및 양육권을 의뢰인에게 전부 인정하는 화해에 이를 수 있었습니다.
